By accessing or using SendSight ("the Service"), operated by Retention Machine ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Accounts

To use SendSight, you must create an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

• You must provide accurate and complete information
• You are responsible for safeguarding your password and API keys
• You must notify us immediately of any unauthorised use of your account
• We reserve the right to suspend or terminate accounts that violate these terms

3. Acceptable Use

You agree to use SendSight only for lawful purposes and in accordance with these terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malware, viruses, or other harmful code
• Share your account credentials with unauthorised third parties

4. Payment and Billing

Certain features of SendSight require a paid subscription. By subscribing, you agree to the following:

• New accounts receive a 7-day free trial with full access to all features
• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by applicable law
• We may change our pricing with 30 days' notice to active subscribers
• Failure to pay may result in suspension or termination of your account
• You are responsible for applicable taxes in your jurisdiction

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Retention Machine and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all data you submit to the Service. By using SendSight, you grant us a limited licence to access, use, and display your data solely for the purpose of providing the Service to you.

6. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. We will delete your data within 30 days of account termination, except where retention is required by law.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Retention Machine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or relating to these Terms or the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
